DEED INDENTURE: PURCHASE OF LAND

This is a contract for the sale of some land by John & Olive (Hewitt) Green to niece Charity Rowland on April 5, 1848 for $675. The sale was recorded in the Book of Deeds 54 on page 58 on June 10, 1848.

This was about four years before marriage to James Claydon, who arrived in New York in the summer of 1848.

On this tenth day of April 1848 before me personally came John Greene and Olive his wife to me known to be the individuals described in and who executed the written conveyance who acknowledged that they executed the same and the said Olive acknowledges on a private examiniation by me made apart from her husband that she executed the written conveyance freely and without any fear or compulsion of him.

Warranty Deed

This Indenture, Made the Fifth day of April one thousand eight hundred and forty eight between John Green and Olive Green his wife of the Town of Greenfield, County of Saratoga and State of New York of the first part, and Charity Rowland of the same place of the second part,

WITNESSETH, That the said parties of the first part, in consideration of six hundred and seventy five Dollars, to them duly paid, have sold, and by these presents doth grant and convey to the said party of the second part, her heirs & assigns forever, all that certain tract piece or parcel of land situate lying and being in the said town of Greenfield County and state aforesaid, being the north ?mouty, on half part of lot no. three of the ?Panatter lots into which lot No. three of the smaller lot into which lot no. two of the subdivision of lot no. two of the smaller lots in lots no. eleven in the twenty second general allotment of the patent of Kayaderossas is subdivided and is bounded as follows, vis Beginning at the north west corner of lot no. three at a stake and a heap of stones, thence north fifty five degrees and thirty minutes east forty chains and seventy links to a stake and a heap of stones standing in the west bounds of lot no. twelve of the subdivision of the twenty second Allotment of said Patent, thence south eighteen degrees and twenty minutes east twelve chains and fifty links to a stake and a heap of stones thence south fifty five degrees and thirty minutes west forty chains and seventy links to a stake and a heap of stones, thence north eighteen degrees and twenty minutes west twelve chains and fifty links to the place of Beginning, continuing fifty acres of land be the same more or less, together

With the appurtenances, and all the estate, title and interest of said parties of the first part therein. AND the said Parties of the first part do hereby covenant and agree that at the delivery hereof they were seized of the said premises of an estate in fee simple therein: also that they have power to sell and convey the same as hereby intended: also that the same is free from incumbrances:

ALSO, that they will WARRANT and DEFEND the above granted premises in the quiet and peaceable possession of the said party of the second part her heirs and assigns, forever.

In Witness whereof, the said parties of the first part, have hereunto set their hands and seals the day and year first above written.
